Please read these Terms of Service ("Terms") carefully before using Smart NFC ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Smart NFC, you agree to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms, please do not use the App.
2. Age Requirement
You must be at least 13 years old to use Smart NFC. By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
3. Description of Service
Smart NFC is an iOS utility for reading and writing compatible NFC tags. The App requires an NFC-capable iPhone running a supported version of iOS.
4. User Accounts
Smart NFC does not require an account. All your data is stored locally on your device. Your data may be included in your device's iCloud backup if you have iCloud backup enabled.
5. In-App Purchases
Smart NFC may offer in-app purchases. By purchasing:
- Payment will be charged to your Apple ID account at confirmation of purchase
- You can restore your purchase on any device signed into the same Apple ID
6. Acceptable Use
You agree not to use Smart NFC to:
- Engage in any activity that violates applicable laws or regulations
- Attempt to circumvent any security features of the App
- Reverse engineer, decompile, or disassemble the App
7. Third-Party Services
The App may use the following third-party services:
- Apple – for in-app purchase processing (via App Store) and iCloud backup. Use is subject to your Apple Media Services Terms and Conditions.
I am not responsible for the practices or policies of these third-party services.
8. Intellectual Property
The App, including its design, features, and content, is owned by me and protected by intellectual property laws.
9. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, either express or implied. I do not guarantee that the App will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.
11. Changes to Terms
I reserve the right to modify these Terms at any time. I will notify users of significant changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the new Terms.
12. Termination
I reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that I believe violates these Terms or is harmful to other users or third parties.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
14. Apple App Store Terms
The following terms apply to your use of the App through the Apple App Store:
- These Terms are between you and me, not Apple. I am solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support services for the App.
- Apple is not responsible for any product warranties, whether express or implied. I am solely responsible for any claims relating to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms.
15. Your Data Rights
You have the right to request deletion of your data at any time. See my Privacy Policy for details on how to exercise this right and what data is collected.
